Compensation for 6 year old

Personal injury expert and Graysons’ partner, Jonathan West, has won £6,000 in compensation for a 6-year-old boy who injured his foot in a pub.

Regan Pierce, who was 6 years old at the time of the accident, visited the Travellers Rest pub in Clowne, Derbyshire, with his family.  He was playing in the children’s area that was located outside, but within the pub’s premises.  Regan saw a bucket on the edge of the grassed area in the play area.  The bucket was left unattended and there were no warning signs on it.  As children do, Regan put his foot in the bucket, which, unbeknown to him, was filled with hot ash.  Regan suffered burns to his foot, which has resulted in permanent scarring.

Regan’s family felt that the accident was not his fault and that the pub should not have left the hot ash, unmarked, in a children’s play area.  They contacted Graysons to see if Regan could claim compensation and Jonathan took up the case.

Jonathan wrote to the owners of the pub suggesting that the accident was caused by their breach of statutory duty and/or negligence in allowing the bucket to be present in the play area and not warning anyone that it was there and what it contained.   The pub owners initially denied responsibility for the accident and so Jonathan issued court proceedings, after which they decided to settle the claim and Jonathan was able to win compensation of £6,000 for Regan, which included out of pocket expenses for his dad.
