Tracey wins compensation for 13 year old boy following Matalan accident

Personal injury specialist, Tracey Dickinson, has won £11,000 in compensation for a 13 year old boy (11 at the time of the accident) who sustained an injury in a shop in Rotherham.

The boy was in the Matalan store in Parkgate, Rotherham with his father and brother and was play fighting with his brother.  Unfortunately he tripped over a clothes display and fell, landing on the sharp edge of another display stand.  The metal edge of the stand on which he fell was not covered with rubber like the others and the boy sustained a bad injury to his leg.

Deep cut causes permanent scarring after Matalan accident 

The cut was deep, exposing the muscle below.  After the initial treatment he suffered numerous setbacks with infections and the skin not healing properly.  The boy has been left with a 3.5cm scar on his left shin, and surgeons originally thought he would need an operation, but he has now made a good recovery without it, although the scar is permanent.

The boy’s mother decided to contact Graysons to see if she could initiate a compensation claim on behalf of her son and Tracey took up the case.

Matalan denies responsibility for accident

Matalan denied liability for the accident throughout the claim and Tracey had to issue court proceedings.  Matalan eventually accepted breach of duty and Tracey was able to negotiate a settlement of £11,000.  As the boy is a minor, the settlement had to be approved by a judge to ensure it was sufficient for the type of injury.  District Judge Kirkham approved the award which will be held in trust for the boy until he is 18.
