Master H was out with his scout group doing nighttime map reading. There was no lighting. The child injury was caused when, unfortunately, he fell over a rock and landed on his knee. He sustained a deep laceration as a result.
He attended hospital to have the wound surgically cleaned and repaired. He has suffered permanent scarring as a result of the accident. The child also suffered psychologically, with the psychologist diagnosing situational anxiety disorder.
The child’s mother contacted Graysons and Tracey took up the case.
Scout Association accepts liability for child injury
Tracey contacted the Scout Association and it accepted liability for the accident but offered a low settlement. Tracey pursued the case at court and was able to negotiate higher damages.
As Master H is a child, the settlement had to be approved at a court hearing with directions for investment until Master H attained 18 years of age.
The court approved damages as negotiated at a significantly higher level than the Scout Association had initially offered and Master H and his mother, who acted as his litigation friend, were extremely happy with the outcome.
