Mr Maccoll, who is a security manager, works nights and travels around a number of buildings throughout the night – usually without any particular event. However, in the early hours of one of his shifts last year, at around 4.15am, Mr Maccoll was travelling from DFS in Darley Dale to Chesterfield and experienced something rather extraordinary – 5 buffalo charging towards him! Shocked of course, Mr Maccoll swerved to avoid the animals which ran into the road after escaping from a specialist meat farm. Unfortunately, one of the animals charged directly towards Mr Maccoll and locked its horns in his car. Mr Maccoll sustained neck, shoulder, finger and knee, as well as psychological injuries and this harrowing experience led to the badly injured animal being shot by a police marksman.
Mr Maccoll brought his case to Graysons, specialists in animal injuries, and we made a claim against the beast’s owner, under the Animals Act 1971. We were able to secure a settlement of £7,000 for nuisance and common law negligence and Mr Maccoll was extremely pleased, saying that Graysons WE was “simply the best solicitors I have ever used. Unfortunately it wasn’t the first time that such an incident had occurred as, in an on-gong case, we are also representing a client who collided with the farm’s cattle on his motorcycle five months earlier on the A632. Let’s hope that the farm owner takes heed of this latest incident, which has clearly cost him dearly, and secure his animals property, otherwise he may find himself subject to our animal claim expertise again in the future.
