The client, Mr M, is a lorry driver and was making a delivery of animal foods. Whilst he was unloading the HGV, he was talking to the forklift truck driver.  As Mr M walked away, the forklift truck started to drive off and he hit the back of Mr M’s ankle, who fell over and was in immediate pain.

Mr M attended hospital and x-rays were taken.  Mr M suffered from existing arthritis in his ankle and an orthopaedic surgeon diagnosed that the accident had aggravated this.

Mr M had to take ten weeks off work, following which he returned to HGV driving.  Unfortunately, he found that he was having difficulty getting on and off the trailer, so he changed jobs to drive smaller lorries that carried pallets.

Defendant admits liability for breach of duty care

After contacting Graysons, Robert took up Mr M’s case and pursued the company for which the forklift truck driver worked. He claimed that the company had breached the duty of care it owed to Mr M, who was a lawful visitor, as a result of their forklift truck driver’s negligence.

The defendant company admitted liability and Robert was able to negotiate a settlement that Mr M was very pleased with.  He said
