The man from the defendant company asked the client to move his car so that he could move his van closer to the client’s property. The man had removed a manhole cover leaving it open and had not put any lights or cones around it nor told the client that the cover was missing.
As the client walked towards his car, his left foot fell into the manhole, fracturing his left ankle in two places and suffering a tear in his right shoulder. The client approached Graysons shortly after the accident to pursue the company for compensation. Joshua took on the case.
Joshua completed investigations to find out who the defendant’s insurer was and approached it. The defendant admitted liability and Joshua proceeded to obtain medical evidence. An orthopaedic consultant advised surgery and the client underwent an arthroscopic rotator cuff repair. The client was also referred to a foot and ankle specialist, who, after later reviewing x-rays, confirmed that there was a low chance of arthritis in the ankle due to the accident, and a psychologist who indicated that the client was suffering from adjustment disorder and depressed mood. The client had suffered various detriments to his life including having to give up his work as an HGV driver, severely affecting the family income.
Although the defendant company had accepted liability for the accident, Joshua had to exercise considerable skills to negotiate a five-figure settlement for his client.
The client was very happy with the result and the fact that Joshua had been able to maximise his claim.
