Jane wins compensation in 16 months for injury at work

Graysons’ partner and head of personal injury, Jane Cooper, has successfully secured compensation for a man who sustained an injury at work, whilst working for a manufacturing company making furniture for the educations sector.

Mr B. was employed as a machine operator. He had only worked for the company for three days. When the injury at work happened, he was drilling holes in steel using a freestanding drilling machine.

He had not been provided with any induction and was only given cotton gloves to do the job, which were penetrated by shards of steel. At first Mr B. suffered pain and irritation, which soon turned to severe pain, resulting in attendance at A & E and hospitalisation for three nights.

Mr. B.’s injuries were extensive, affecting his dominant right hand. He underwent two surgeries and narrowly avoided the amputation of his middle finger. His fingernail has stopped growing. He has also suffered injury to his palm and could not straighten his fingers. He had to wear a splint on his hand and suffered severe grip weakness. Physiotherapy was necessary.

Sadly, the injury made it difficult for Mr B. to obtain other work.

The client contacted Graysons and Jane took up the case.

Employer denied liability

Jane pursued Mr B’s employer who denied liability and Jane issued court proceedings. The employer then offered to deal with the claim on a ‘without prejudice’ basis and Jane was able to settle the case.

The client was delighted that Jane had been able to settle the matter in just over 16 months – which is particularly quick in a case where liability has been denied, and court proceedings are involved for a serious injury of this type.

Jane was able to achieve five-figure damages for Mr B. and ensured that the payment was made quickly to enable him to resolve a housing issue.
