Government abandons proposed personal injury changes

The government today has scrapped proposals to make sweeping changes to legislation that would have meant that personal injury whiplash claims of less than £5,000 would have had to be handled by the Small Claims Court.

As part of the run up to the forthcoming general election on 8th June all pending legislation must be rushed through or abandoned before Parliament is dissolved.  The Prisons and Courts Bill, which has not yet cleared committee stage, and is where the personal injury changes are incorporated, is one of the abandoned bills.

The bill had proposed changes to whiplash/soft tissue injury claims, including the £5,000 limit and a tariff of compensation for claims for less than that.  It had also proposed that all other types of personal injury claims of less than £2,000 would have to go through the Small Claims Court.

It is likely that a new government will propose new legislation and we will report on that as soon as we know about it.
