Ms K was standing in the car park of a pub in Wombwell talking to another person about the dog she was walking when she was hit by the taxi. She fell to the floor, sustaining injury to her left knee. She was also shocked and shaken. The taxi driver was alerted to the incident only by his passengers. Ms K was taken to Barnsley District General Hospital.
Ms K contacted Graysons to see if she could claim compensation from the taxi driver’s insurer and Amy-Jo took up her case. Amy-Jo contacted the taxi driver claiming that he had caused the accident due to his negligence in that he had:
- failed to keep a proper look out and had collided with Ms K, despite the fact that she was clearly visible
- driven too fast to avoid the collision and without reasonable concern for the safety of Ms K and other pedestrians
The taxi driver denied liability for the claim throughout and Amy had to issue court proceedings. Fortunately, the taxi driver decided to settle the claim before it went to court and Amy Jo was able to negotiate a settlement of £1,800. Ms K was delighted with the help that Amy Jo had given in helping her to win compensation in a difficult case.
