Ms A was using the spa area at the Dome in Doncaster. As she walked down a flight of stairs to the steam room, she slipped on the steps. She had used the spa facility before, and had noticed an attendant had been on duty, wiping away excess water. On this occasion, however, there was no attendant and there was an excess of water on the steps.
Slip on spa steps causes injury
A fellow spa user got assistance and the accident was recorded by the Dome. Not wanting to be taken to hospital by ambulance, Ms A contacted her partner and he took her to A & E at Doncaster Royal Infirmary. X-rays were taken and confirmed that Ms A had not broken any bones. Her arm was put in a sling and she was given pain killers. Ms A was in severe pain for several days and she remained stiff and unable to carry out certain tasks, or sleep properly, for some time.
Tracey pursues Dome for compensation
Believing that the Dome was responsible for her accident, Ms A contacted Graysons to see if she could claim compensation and Tracey took up her case.
Tracey contacted the Dome claiming that it had been negligent and had breached its statutory duty of care to her client. The company denied liability for the accident, however, saying it had a reasonable system of cleaning and inspection in place.
Medical evidence confirmed that Ms A had a shoulder injury that would last for 6 – 9 months and Tracey issued court proceedings against the Dome, but was able to negotiated a settlement of £2,050 without attending court.
