Compensation for widow of man who died as a result of gastric lymphoma

Graysons’ medical negligence expert, Nikki Yavari, has won £30,000 from Sherwood Forest Hospitals NHS Foundation Trust for the estate of Mr S who died as a result of an undiagnosed gastric lymphoma.

Mr S was 63 when he suffered a fatal gastrointestinal haemorrhage, which was secondary to the gastric lymphoma.

Mr S’ widow contacted Graysons following her husband’s death in January 2011 to see if she was able to claim compensation for medical negligence due to the hospital’s failure to diagnose the gastric lymphoma.  Mrs S claimed that, over a period of approximately 10 months from April 2010, when her husband was under its care,  the hospital failed to notice a discrepancy in tests undertaken which should have indiated that the lymphoma was present, and failed to carry out a CT scan.  The CT scan, Mrs S claims, would have demonstrated the lymphoma at an early stage, which would have led to a laparoscopic biopsy confirming the diagnosis.  Her husband would then have been able to undergo chemotherapy and would not have suffered the fatal haemorhage.

Hospital denies liability for breach of duty of care

Whilst the hospital admitted that Mr S’ death might have been avoided with earlier treatment, and that his prospects of a cure would have exceeded 50%, it denied that it’s employees had breached their duty of care.

Nikki instigated court proceedings and the case was due to be heard in Chesterfield County Court, commencing 1st March 2017.  In the meantime, however, the NHS offered a settlement figure of £30,000.  Mrs S decided to accept the settlement and she was happy with the outcome of the case.
