He was taken to Sheffield’s Northern General Hospital, where he was diagnosed with a broken arm (humerus) and injuries to his chest and back.  Despite post-accident medical attention and physiotherapy, the pensioner has been left with permanent restriction of movement in his shoulder.

SYPTE admit liability for accident at bus stop

The man contacted Graysons to see if we could help claim compensation.  Graysons contacted South Yorkshire Passenger Transport Executive (SYPTE) claiming that it had breached the Occupiers’ Liability Act 1957, exposing the client to danger in that it had:

  • Allowed the shelter to become and remain a danger due to non-existence of glass
  • Failed to inspect and maintain/repair the shelter
  • Failed to warn people about the missing glass

SYPTE admitted liability and Graysons was able to negotiate a settlement of around £11,300, securing a higher amount than had been expected.
