Composing himself, he got up off the floor, and whilst he realised that he had hurt his lower back, he did no more about it, although he did notice that there was no sign warning of the water’s presence, and the cleaner’s report showed that the toilets had not been attended to for around 5 hours. Craig did have the forethought to take photographs of the water and timesheet.
Shane went on holiday, and when he came back, he advised the Hilton about the accident, but did nothing else. Over the next 10 months, Shane’s back pain got worse. It was intermittent and accompanied by pain at the top of his left leg and some pins and needles in the same leg. He visited his doctor, who diagnosed muscle spasm and prescribed pain killers.
Shane contacted personal injury specialist, Jonathan West, here at Graysons WE, who pursued the Hilton Hotel. Hilton admitted liability straight away and compensated Shane with £3,500. Jonathan does feel that the case may have been worth more as experts recommended physiotherapy and a further review, but Shane was content with the payout and wanted the case to be settled quickly. Jonathan says “Whilst such claims do need to be made within a 3 year period from the accident, Shane’s case does go to show that they don’t have to be made immediately. It is always possible to contact us at a later date if symptoms occur or worsen – or if you feel that you should be making a claim, when you hadn’t done in the first place.”
