Accompanied by her grandson and great grandson, Mrs Smith was walking along B & Q’s footpath one Sunday afternoon when she suddenly caught her foot in something and fell to the ground, landing heavily on her left hand side. Bizarrely, she had fallen over the very thing that was actually supposed to warn people of hazards – a striped bollard – but this one was laid on its side, rather than standing upright at the corner of the pavement and grass verge.
Waiting in B & Q’s café with one of the DIY store’s first aiders, who had taken photographs and completed an accident report, Mrs Smith was in a lot of pain and dared not take her arm out of her coat. When her daughter took her to the hospital A & E, it confirmed that Mrs Smith had broken her left humerus – the bone around the ball and socket of her shoulder. Her arm was put in a sling and she was sent home with painkillers and told to rest.
A return visit to the fracture clinic showed that Mrs Smith needed an operation, for which she had to wait 8 weeks, all the time in pain and unable to pick up heavy things. As a carer for her husband, who suffered from dementia, this made life very difficult for her. Her operation was followed by several weeks of physiotherapy and she still suffers severe pain and difficulty in lifting a year after the accident. A medical specialist believes that she will suffer stiffness for the rest of her life.
Jonathan contacted B & Q and was able to secure a settlement of £26,500 for Mrs Smith, who said “I would recommend Jonathan to anyone. He was fantastic and I would use him as my solicitor again any time.”
