Andrew Spriggs was driving down Abbey Lane, preparing to turn into Whirlowdale Road. As he turned into this road, the driver behind him ran into the back of Andrew’s car. Andrew suffered pain in his left side, neck and shoulder as a result of the accident. He struggled for some time with the pain and had to seek medical attention.
Amy-Jo issues court proceedings
Andrew contacted Graysons to see if he could claim compensation and Amy-Jo took up his case. She contacted the insurance company of the man who collided with Andrew and it accepted liability for the accident. Unfortunately, the insurance company did not agree with the genuine valuation of the claim and did not make an acceptable offer, so Amy-Jo issued court proceedings. However, before the case went to court, the insurer offered £5,700 and Andrew accepted the offer.

“In my experience, defendant insurers often try to settle cases for less than the actual value, despite the Ministry of Justice’s process for this type of case.”
Government proposals for road traffic accident compensation
Under the government’s original proposed changes to personal injury compensation (currently on hold, to be included in some guise as part of the Civil Liability Bill), had Andrew Spriggs dealt only with the insurer on this matter it would have fallen under the £5,000 proposed limit for soft tissue injuries. Under that proposal, Andrew would have to take his claim to the Small Claims Court himself, with no solicitor help, or his compensation would be based on a sliding scale, starting at £225. We don’t think the proposed changes are fair, and neither does Andrew, who said that he is
“sickened to hear of the changes to law about personal injury and how compensation will be much more greatly limited”.
Andrew was very pleased with the outcome of the case and with the service he received from Amy. He said:
