£10,000 for mobility shop fall

Graysons personal injury specialist, Jonathan West, has won £10,000 for 80 year old Norfolk resident, Mrs Neal, after she fell and in a mobility shop in Hunstanton.

How did the injury happen?

Mrs Neal visited Mobility 2000, which was being refurbished at the time of her visit. When she entered the store she immediately tripped and fell on the unsigned, raised wooded edge of the inlaid entrance mat.

What injury did Mrs Neal sustain?

Mrs Neal banged her left shoulder on some shelving and was immediately in pain. An ambulance was called and, after examining her, a paramedic took her home and told her to rest. The pain didn’t go away so Mrs Neal went to hospital where an examination and X-rays showed that nothing was broken and she was again told to go home and rest.

Mrs Neal’s GP gave her cortisone injections and diagnosed her with a rotator cuff injury, something she was informed would take a long time to heal. Various treatments were offered to Mrs Neal such as an ultrasound, MRI, injections, physiotherapy and even an operation, but she decided that she didn’t want to take them due to her age, deciding instead to try and cope with the restricted movement the injury caused.

How did Graysons help her?

Mrs Neal contacted Graysons and solicitor Jonathan took up her case. Jonathan contacted Mobility 2000 who initially denied liability for Mrs Neal’s injury, but ultimately made two offers before eventual settlement:

  • Firstly a sum of £1,000 was offered before medical reports came in.
  • Once medical reports came in, Mobility 2000 increased it’s offer to £1,700.

Jonathan didn’t think that was acceptable and advised Mrs Neal that it might prove beneficial to go to court. Jonathan issued court proceedings, but Mobility 2000 decided to settle out of court and Jonathan won £10,000 in compensation for Mrs Neal.

Jonathan (pictured left) says ‘It is not always necessary to issue court proceedings on personal injury cases, and often, even when they are issued, the defendant agrees to settle before going to court. Most personal injury cases are, in fact, settled by negotiation, without the need to go to court. In this particular case I really didn’t think that Mobility 2000 was taking the matter seriously and the issue of proceedings made them look at the case more closely! ”
