Compensation for fall at Stocksbridge Leisure Centre

Tracey Dickinson, one of Graysons’ personal injury specialists, has won £3,500 for a client following a fall at Stocksbridge Leisure Centre.

Ms D was attending her daughter’s swimming lesson and was in the spectators’ area.  The seats on which she was sitting were in a raised area that had a step down from them.  Unfortunately, she did not see the step, which was not conspicuous as it was the same colour as the surface beyond it.  When she got up and walked along the seated area, she fell down the step, hurting her thigh, ankle, chest and face.  She suffered for ten months.

Ms D contacted Graysons to see if she could claim compensation and Tracey took up her case. She got in touch with Stocksbridge Leisure Centre (4SLC Trust).  As the trust did not comply with pre-action protocol to disclose documents, Tracey had to issue an application to court for the same.  The trust did eventually admit liability but suggested that Ms D should accept 50% contributory negligence and made a very low offer, so Tracey commenced court proceedings.  Tracey made an offer of £3,500, which the defendant’s solicitor accepted as it did not want to proceed with a formal defence.  Ms D was very happy with the outcome, in particular, that Tracey had fought the claim of contributory negligence and the fact that none was found. The step has since been highlighted.
