Accident at school leads to compensation

Graysons’ personal injury specialist, Tracey Dickinson, has won a case in which she recovered compensation for a ten-year-old girl.

At the time of the accident, Miss A was at Wybourn Community Primary School, Sheffield and it was lunchtime. At this school there is a play pod from which the children are able to help themselves to different equipment.  Miss A took a piece of rope and decided to make a swing.  She tried to attach the rope to a basketball net by throwing the rope up over the net.  However, when she went to swing on the rope, she discovered that it was not secure and she fell, landing heavily on her left foot and injuring it.  She sustained a displaced fracture to her left foot and had to take three days off school.  She was in pain for some time, with disturbed sleep, but made a full recovery within two to three months.

Miss A’s mum contacted Graysons to see if she could claim any compensation for her daughter from the council, as it is responsible for the school and she felt that the school had not looked after her daughter properly.

Tracey took up the case and contacted Sheffield City Council alleging lack of supervision.  The council admitted liability without argument as Miss A should have been adequately supervised.

As Miss A is under 18 years of age, any settlement has to be approved by the court and the court requires a barrister’s opinion on the value of the claim. The barrister advised that the injury should bring compensation of between £1,750 and £2,000.  Tracey made an offer to the council to settle the case at £2,563 and it was accepted.  The money has been invested in Miss A’s ISA account, where it stays until she is 18 years old.

Both Miss A and her mum were very happy with the outcome.
