Mrs Bannister had parked in the Sainsbury car park in Crystal Peaks. She was crossing the car park when she fell over a bump in the tarmac that she had not seen. She didn’t think anything further until about an hour later when her foot became swollen and painful.
She attended A & E and x-rays showed that she had fractured the 5thmetatarsal in her foot. She was given a boot to wear. She was unable to do heavy work for some time, everyday tasks were difficult, and she was not able to play table tennis, nor go to the gym, both of which she did regularly. However, she recovered completely in two to three months.
Mrs Bannister contacted Graysons to see if she could gain redress and Jonathan took up her case. He contacted Crystal Peaks management. It said that it did know about the defect and it had been covered it with a cone, but the cone had been moved. At the time, there was a dispute between the management company and contractors relating to defects and repair.
The company denied responsibility for the accident, so Jonathan had to issue court proceedings. However, he was able to agree a settlement of £2,000 before the case got to court.
