Tracey wins compensation for child

Tracey Dickinson, a personal injury specialist at Graysons Solicitors, has won £1,500 in compensation for a child who had an accident and injured her toe.

As a child, Tracey’s client must be represented by an adult litigation friend, who in this case, was the child’s mother, Donna Campbell.

Donna’s daughter was 3 ½ years old at the time of the accident.  She had visited an off license/convenience store in Rotherham with her mother.  On the way out of the shop through the main entrance, the child got her foot stuck on the underneath of the door and, as she was wearing open toe sandals, her big toe nail was ripped back, cutting the skin.

Donna took her daughter straight to the minor injuries unit of Doncaster Hospital where the girl’s toe was x-rayed.  Bone injury was excluded, but the child had sustained severe soft tissue injury which stopped her normal activities for around 2 weeks.  The child was fully recovered after one month.

Compensation for child approved by court

Donna contacted Graysons to see if she was able to claim compensation for her daughter and Tracey took up her case.  She contacted the owner of the shop who admitted liability.  Tracey was able to negotiate a settlement of £1,500, which was more than barristers had suggested.  As the client was a child, the amount needed to be approved by the court.  Approval was given and the money has been put into trust until the child reaches the age of 18.
