Compensation for holiday accidents

The holiday season is getting underway with many of us enjoying or about to enjoy our well-earned breaks in the sun.  Most of us thoroughly enjoy our time away and our holidays go without specific event, but what if you or a member of your family has an accident abroad?  What can you do about it?

Holiday accident on wet bar floor in Benidorm

Ms A was on a 14-day package holiday in Benidorm, Spain.  It had been raining most of the day and, when she walked into the bar area, which had a smooth, polished floor, she slipped and fell backwards.  The floor was wet because of the rain and hadn’t been dried, creating a slipping hazard.  Ms A fractured her wrist and suffered bruising and shock.  Had the accident been in the UK, the claim would have been fairly straight forward, but in Spain local safety standards apply and the claim had to be based on safety standards that applied to hoteliers in Spain.  Graysons gained the assistance of a Spanish lawyer and applied the Local Spanish Civil Code and Workplace Directives and secured compensation against the travel company that the package tour was booked with.

Cruise holiday accident

Another slipping accident led to compensation when Ms B was on a cruise holiday sailing the Red Sea.  Ms B walked into the ladies’ toilets and, after having taken only 2 steps, slipped and fell forwards.  She hit her hip on the wall of a toilet cubicle and twisted as she fell to the floor, injuring herself.  The floor was laid with smooth tiles and was wet, which made it slippery.  Graysons pursued the tour operator for negligence and breach of the Athens Convention and Package Travel Regulations and won £7,000 compensation for the client.

Snowmobile accident compensation

It isn’t only summer holidays that can lead to accidents.  Graysons has also won compensation for a client, Mrs C, who went with her family on a day trip to Finland, on the ‘Santa Experience’.   When they arrived they joined a queue of around 15 people to have a go on the snowmobiles.  There were 5 snowmobiles, all in use, which were not separated from the queue by any ropes or barriers and the area was badly lit; the only light came from a fire and the snowmobiles themselves.  Mrs C could hear the female instructor giving brief instructions on how to use the vehicles.  The instruction only lasted a few seconds, discussing breaks, accelerator and emergency cut out, but the briefness of lesson and the poor light meansnowmobilest that users weren’t really sufficiently familiar with the controls.  As Mrs C waited in the queue, one of the snowmobile users lost control of the vehicle and hurtled towards her, hitting the person in front of her and then herself.   She suffered a soft tissue injury to her spine and a fractured fibular (lower leg). Graysons took up her case, and, applying Finnish safety standards relating to the use of snowmobiles, secured £6,000 compensation for the client.
