7 year old breaks tooth on Aunt Bessie’s toad in the hole

Toad in the hole is a favourite food for most children, but after painfully breaking a tooth whilst eating it, Henry, now 9 years old, from Huntingdon in Cambridgeshire, is unlikely to try again for some time!  However, Graysons’ personal injury specialist, Jon West, was able to sweeten the pain a little by winning £1,000 compensation for the young lad.

Henry was only 7 years old at the time.  He was eating his Aunt Bessie’s toad in the hole, which his mum, Erika, had bought from Tesco. Suddenly, Henry stopped chewing and spat out part of a tooth that had broken on a piece of bone that had been in the food.  Needless to say, he was shocked and in pain as his tooth had broken.

After the traumatic incident, a couple of visits to the dentist for a cap and a filling eventually sorted Henry’s tooth, but Aunt Bessie’s were not at all keen to say sorry!  A £10 voucher – as a good will gesture – seemed to be enough for the company; but no apology.  Erika was not at all happy with this and asked for an apology and proper compensation for pain, suffering and the time she’d had to take off work to take Henry to the dentist and care for him.  Aunt Bessie’s said it didn’t pay ‘compensation’, so Erika contacted Graysons to find out what could be done.

Of course the toad in the hole should not have had bone in it, it was clearly defective.  Jon took up the case and contacted Aunt Bessie’s who agreed to pay £1,000 in compensation to Henry.
